Acceptance of Terms

Welcome to CureCode Solutions LLC (“CureCode Solutions,” “we,” “us,” or “our”). By accessing and using our services, which include but are not limited to revenue cycle management, electronic health records (EHR), patient management, telemedicine, and other healthcare administrative solutions, you agree to comply with these Terms and Conditions (“Terms”). Please read these Terms carefully, as they constitute a legally binding agreement between you and CureCode Solutions. If you do not agree to these Terms, you must discontinue the use of our services immediately.

Modifications to Terms

CureCode Solutions reserves the right to modify, amend, or update these Terms at any time without prior notice. Any modifications will be effective immediately upon posting on our website or other communication channels. By continuing to use our services after changes are posted, you accept the revised Terms. It is your responsibility to regularly review these Terms for any updates or changes.

Services Provided

CureCode Solutions offers a comprehensive suite of healthcare administrative services, including but not limited to medical billing, coding, EHR management, patient management, telemedicine solutions, and complete revenue cycle management. Our services are designed to assist healthcare providers in streamlining their administrative processes, improving operational efficiency, and ensuring compliance with healthcare regulations. Our services are provided in accordance with New Mexico state laws, as well as all relevant federal and state healthcare regulations, including HIPAA and HITECH Act requirements.

User Responsibilities

By using CureCode Solutions’ services, you agree to adhere to the following responsibilities:

• Lawful Use: You agree to use our services only for lawful purposes and in a manner consistent with applicable laws and regulations.
• No Unauthorized Access: You will not attempt to gain unauthorized access to our systems, networks, or any confidential information. Unauthorized access includes hacking, password mining, or any other method of circumvention.
• Confidentiality: You agree to keep any information accessed through our services, including patient information and proprietary technology, confidential and secure. Any unauthorized sharing or misuse of this information is strictly prohibited.
• Compliance: If you are using our services on behalf of a healthcare provider, you agree to comply with any applicable industry regulations, including HIPAA.

Payment and Billing

All fees for services are outlined in your service contract or as otherwise communicated. Payments are due according to the terms agreed upon in your contract. Failure to make timely payments may result in service suspension or termination. CureCode Solutions reserves the right to impose late fees or interest charges on unpaid balances, as well as to engage a third-party collection agency if required. You are responsible for any collection fees or legal costs incurred in collecting overdue payments.

Intellectual Property Rights

All content, materials, and technologies provided through our services, including logos, trademarks, software, designs, and information, are the exclusive property of CureCode Solutions or our licensors. You are granted a limited, non-transferable license to use the services for their intended purpose only. Any reproduction, distribution, modification, or unauthorized use of our intellectual property is strictly prohibited without express written permission from CureCode Solutions.

Disclaimer of Warranties

CureCode Solutions provides its services on an “as-is” and “as-available” basis. We make no representations or warranties of any kind, express or implied, as to the operation, functionality, or reliability of our services. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted access to our services and are not responsible for any disruptions, delays, or errors in service.

Limitation of Liability

Under no circumstances shall CureCode Solutions be liable for any indirect, incidental, punitive, or consequential damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of our services. Our liability is limited to the total amount paid by you for the services during the twelve (12) months preceding the event giving rise to the claim. This limitation applies even if we were advised of the possibility of such damages and regardless of the legal theory on which the claim is based.

Confidentiality and Data Security

We take data security seriously and follow HIPAA guidelines to safeguard personal health information (PHI). We implement administrative, technical, and physical safeguards to protect your data from unauthorized access, use, or disclosure. However, no security measures are foolproof, and we cannot guarantee absolute security. You acknowledge that you share responsibility in protecting data and agree not to disclose any proprietary, confidential, or sensitive information obtained from CureCode Solutions without our prior written consent.

Termination of Services

CureCode Solutions reserves the right to suspend or terminate your access to our services at our discretion, with or without prior notice, if we believe you have violated these Terms or applicable laws, or if we determine it is necessary to protect the integrity and security of our services. You may also terminate your account with CureCode Solutions by providing written notice as per the terms of your service agreement.

Governing Law and Dispute Resolution

These Terms and any disputes arising from your use of our services shall be governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflicts of law principles. Any disputes that cannot be resolved informally shall be submitted to binding arbitration in New Mexico, following the American Arbitration Association’s rules.
